VI BELLA JEWELRY TERMS & CONDITIONS

These terms and conditions (Agreement), apply to your purchase of product from Vi Bella Jewelry and to the use of the website vibellajewelry.com

These terms and conditions of sale apply to all purchases. By placing an order and/or accepting delivery of Product, you accept and are bound to the terms and conditions of this Agreement.

ORDERS PAYMENT
Orders placed do not constitute a legal contract until Vi Bella Jewelry ships the Product. Terms of payment are within Vi Bella Jewelry’s sole discretion, and unless otherwise agreed to by Vi Bella Jewelry, payment must be received by Vi Bella Jewelry prior to Vi Bella Jewelry’s acceptance of an order. Payment for the Product may be made by credit card, wire transfer, or some other prearranged payment method. If payment is made by credit card, acceptance of orders is subject to credit card verification procedures. We reserve the right to cancel an order if it does not meet our credit card verification standards. If payment is made by personal check, Product will not be shipped until the check clears. Your order is subject to cancellation by Vi Bella Jewelry, at Vi Bella Jewelry’s sole discretion. Vi Bella Jewelry is not responsible for pricing, typographical, or other errors, in any offer by Vi Bella Jewelry and Vi Bella Jewelry reserves the right to cancel any orders resulting from such errors. Reserved Rights: All prices and availability are subject to change without notice.

TAXES AND FEES
You are responsible for determining and paying the appropriate government taxes, fees, and service charges resulting from a transaction occurring through the Service. We are not responsible for collecting, reporting, paying, or remitting to you any such taxes, fees, or service charges.

CHARGES; TITLE; RISK OF LOSS; TAXES:
Shipping and handling charges are additional unless otherwise expressly indicated at the time of sale. Title to Product passes from Vi Bella Jewelry to you upon shipment from Vi Bella Jewelry’s facility. Loss or damage that occurs during shipping by a carrier selected by Vi Bella Jewelry is Vi Bella Jewelry’s responsibility, HOWEVER, Vi Bella Jewelry will not be responsible for any physical damage to any shipment if it is not inspected at the time of delivery and damages or suspected damages are not clearly noted on the carrier’s paperwork at the time of delivery. Loss or damage that occurs during shipping by any carrier selected by you is your responsibility. You must notify Vi Bella Jewelry within 5 days of the date of your purchase if you believe any part of your purchase is missing, wrong or damaged. Unless you provide Vi Bella Jewelry with a valid and correct tax exemption certificate applicable to your purchase of Product and the Product ship-to location, you are responsible for sales and other taxes associated with the order. Any quoted shipping dates are estimates only.

HANDCRAFTED PRODUCTS
Vi Bella products will vary slightly because each piece is made by hand. Each piece may look slightly different in color and size from samples shown on our website, by our ambassadors, or in printed materials. Many products are one-of -a-kind and no two are alike!

RETURN/EXCHANGE POLICY
We love our products and know that you will too. If you are not completely satisfied with your purchase, you are welcome to exchange any unused items.

If you purchased your jewelry at a Gathering, Fundraiser or through an ambassador, please contact the ambassador that is listed on your invoice.

Replacements for the same item are allowed if the Exchange/Return form, original receipt and jewelry
item(s) is returned within 90 days of the ship date on the invoice.

Exchanges (for a different item) are allowed if the Exchange/Return form, original receipt and jewelry item(s) is returned within 60 days of the ship date on the invoice.

Refunds are allowed if the Exchange/Return form, original receipt and jewelry item(s) is returned within
30 days of the ship date on the invoice.

If you purchased the item online or through a group fundraiser, please contact Vi Bella customer service:

• You will be emailed an Exchange/Return form.
• This form, along with a scanned copy of your original invoice can be emailed to
customerservice@vibellajewelry.com, OR This form, along with a copy of your original invoice can be
mailed to Vi Bella at 1275 7th Avenue NE, Sioux Center, IA 51250.
• Upon receipt of the Exchange/Return form and the copy of your order invoice, Vi Bella will mail your
new item with a postage paid envelope to return the wrong or defective item. Vi Bella covers return
postage for defective item, item is damaged in shipping, or the wrong item was sent. Vi Bella does not
cover postage if you ordered the wrong item or changed your mind.

• Refund:
• If you paid with cash or check, Vi Bella will issue the refund to you by check.
• If you paid by credit card, Vi Bella will issue the refund to your credit card.
*** Gift cards cannot be returned or exchanged. Gifts cards do not have an expiration date.
*** Lost items or items damaged due to normal wear are not covered under our replacement policy

CHILDREN
Vi Bella Jewelry is committed to the well-being and safety of children. Persons under the age of majority in his or her jurisdiction of residence may not enroll as Vi Bella Ambassadors or register as customers. No part of the Service is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS The Service AT ANY TIME OR IN ANY MANNER.

LIMITATION OF LIABILITY
ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT ARE DISCLAIMED BY VIBELLA JEWELRY. VIBELLA JEWELRY DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, OR LOSS OF BUSINESS. EXCEPT AS EXPRESSLY PROVIDED HEREIN, VIBELLA JEWELRY WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, VIBELLA JEWELRY IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT PAID FOR THE APPLICABLE PRODUCT.
GOVERNING LAW

The parties agree that this Agreement, any sales thereunder, or any claim, dispute or controversy (whether in contract, tort, or otherwise, whether preexisting, present or future, and including statutory, common law, and equitable–preexisting, present or future, and including statutory, common law, and equitable claims) between you and Vi Bella Jewelry arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement, Vi Bella Jewelry’s advertising, or Vi Bella Jewelry’s website shall be governed by the laws of the state of Iowa, U.S.A., without regard to conflicts of laws rules. Any actions, regardless of form, arising out of your transaction with Vi Bella Jewelry or the product must be brought within the applicable statutory period, but in no event more than one year from the date of purchase of product.

TRADEMARKS AND COPYRIGHTS
All material from this website is considered property of Vi Bella Jewelry and unauthorized use of such material is strictly prohibited. This includes any content such as graphics, hyper-links, images, text, etc. The content on this site is exclusive to Vi Bella Jewelry. Federally Registered Trademarks, and Logos used and displayed on this Website are considered property of Vi Bella Jewelry. No material may be uploaded, posted, copied, reproduced, distributed or republished in any way. No portion of this site may be copied, sold, reproduced, duplicated, resold or otherwise exploited for any commercial purpose that is not permitted by Vi Bella Jewelry. The VI Bella Jewelry Logo or Trademark may not be used in connection with any product or service that is not ours, in any manner that may cause confusion among customers, or that discredits or disparages us.

Trademarked logos displayed on this site from partner companies are displayed by Vi Bella with permission from these partner companies, and are not to be copied in anyway or used without permission.

GENERAL PROVISIONS
We make no representations that the Content on the Service is appropriate or available for use in any particular location. Those who choose to access the Service do so on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.
If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. No waiver of any provision of these Terms by Vi Bella Jewelry shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

BINDING AGREEMENT
Please read these terms carefully before using this service. Each time you use this service, you agree to these terms. They constitute a binding agreement between you and Vi Bella Jewelry. If you do not accept these terms, do not use this service.
